Wholesale Terms and Conditions
SIP SATISFACTION GUARANTEE. We know it's a commitment to bring on a new brand. We don't take that lightly. We will do our best to help you be successful and make it right, no matter the situation.
ORDER MINIMUMS. Please see your sales rep, account coordinator, or marketplace for order minimum.
SHIPPING. Products are made to order and typically ship within 7–10 business days of order confirmation. Orders ship via USPS or carrier of our choice unless otherwise agreed in writing.
Title and risk of loss transfer to Buyer upon delivery to the carrier (FOB Shipping Point). Buyer assumes responsibility for providing accurate shipping information. Plum Deluxe is not responsible for delays, damages, or losses caused by carriers or events beyond our reasonable control.
Buyer is responsible for all shipping costs, forwarding fees, duties, taxes, tariffs, and brokerage fees.
PRICING. 1 oz teas carry a Minimum Advertised Price (MAP) of $8 per ounce. Wholesale accounts may not advertise products below MAP without prior written approval from Plum Deluxe. This includes online listings, email promotions, and publicly visible pricing.
Discounts applied at checkout (not publicly advertised) do not violate MAP. Free shipping or value-added promotions do not violate MAP.
Violations may result in suspension or termination of wholesale privileges. Custom blends are exempt from MAP unless otherwise specified.
AVAILABILITY. Because Plum Deluxe purchases the freshest ingredients as close to directly from the source, availability of items is not guaranteed. Delays in shipping, weather, and other factors out of the control of Plum Deluxe may affect product availability. Plum Deluxe reserves the right to discontinue or modify products at any time.
WEB COMMERCE AND 3RD PARTY SALES. No products or goods purchased from or produced by Plum Deluxe shall be resold by or through any on-line auction or online store (eBay, Amazon, etc.) without the express, written authority of Plum Deluxe. Wholesale accounts may sell their own custom blends online, however. Plum Deluxe does not allow for wholesale accounts to act as a distributor and resell Plum Deluxe goods and products.
PAYMENT TERMS. In general, all orders must be accompanied by pre-payment. We accept credit card payment online unless specified otherwise.
RETURNS. Order discrepancies or damage must be reported in writing within 5 business days of receipt. Photographic documentation may be required. Per food regulatory compliance, we cannot accept returns.
DISCLAIMER. Statements regarding Plum Deluxe products have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease. Wholesale accounts agree to represent Plum Deluxe products in a manner consistent with brand guidelines and may not make health claims beyond those provided by Plum Deluxe.
LIMITATION OF LIABILITY. Plum Deluxe makes no warranties, express or implied, including warranties of merchantability or fitness for a particular purpose. Buyer assumes responsibility for proper storage, handling, and resale of products. Buyer agrees to indemnify and hold Plum Deluxe harmless from claims arising from misuse, improper storage, or misrepresentation of products.
RIGHT OF REFUSAL. Plum Deluxe reserves the right to approve, suspend, or terminate wholesale accounts at its discretion.
BILLING DISPUTES. Buyer agrees to contact Plum Deluxe to resolve any billing disputes prior to initiating a chargeback. Unauthorized chargebacks may result in suspension of wholesale privileges. Buyer agrees to reimburse reasonable collection costs, including attorney fees, if collection efforts become necessary.
GOVERNING LAW. This Agreement shall be governed by the laws of the State of Oregon.
Plum Deluxe Tea reserves the right to change the terms of this Agreement as necessary. Prices are subject to change without notice.
